When you sign up to the MoneyPlus Rewards scheme through this mobile application, you are agreeing to these Terms and Conditions of Service, so it is important you read these Terms in full, alongside our Privacy Notice. Information about us.

This mobile application (“app”) and its associated services are designed and operated by MoneyPlus Rewards, a trading style of MoneyPlus Group Limited (company registration 07310059). Our main trading address is Riverside, New Bailey Street, Manchester, M3 5FS.

If you choose to access your MoneyPlus Energy account through this app, your data will only be accessible by MoneyPlus Energy Limited. For more information on how your data is used through this app, please read the Privacy Notice

MoneyPlus Rewards and MoneyPlus Energy are both part of the MoneyPlus group of companies, which provides a range of lifestyle services designed to save our customers money and help them live better. MoneyPlus Rewards in a nutshell.

We operate the MoneyPlus Rewards scheme to earn you cashback on your qualifying purchases, which you can then use to pay towards your plan renewal with MoneyPlus Energy. 

You can collect your cashback credit by visiting any participating retailer listed in this app and making a purchase. When you make a qualifying purchase, we are notified, and your cashback will be added to your digital wallet. To facilitate this, you will need to register at least one debit or credit card in this app. You can also include cards held in another person’s name (with the cardholder’s permission) so your friends and family can help you build up cashback.

Once in every 12 month period, you can redeem the cashback in your digital wallet towards your renewal with MoneyPlus Energy. You are responsible for making sure your MoneyPlus Energy bill is paid in full.

Once a year, you can redeem the cashback in your digital wallet towards your renewal with MoneyPlus Energy. You are responsible for making sure your MoneyPlus Energy bill is paid in full. 

You can also use this app to check your MoneyPlus Energy account, including accessing your bills, uploading meter readings, and making payments. You do not have to use your MoneyPlus Energy account through the app to access the MoneyPlus Rewards scheme, but you will need to log in to your MoneyPlus Energy account through the app to link the two accounts.

1. Registering your account.

When you download the app, you will be invited to sign up for the MoneyPlus Rewards scheme. If you wish to just use the app to use your MoneyPlus Energy portal, you do not need to sign up to MoneyPlus Rewards and these Terms will not apply.

If you wish to use the MoneyPlus Rewards scheme, you must be aged 18 years or over, be a UK resident and either be the bill-payer or have the permission of the bill-payer for the linked MoneyPlus Energy account. 

To set up your MoneyPlus Rewards account and access the features of the App, you will need to provide a valid name, email address, and mobile phone number. You will also need to create a password for security. By clicking ‘Create Account’ and submitting this information, you are commencing your Agreement with MoneyPlus Rewards and these Terms will apply.

You can also choose to enable fingerprint or face ID logins to the app using your device’s biometric data. If you choose to do this, your biometric data is only stored in your device, we do not have access to it.

Once your account is set up, you will need to register at least one active credit or debit card by using the Manage Cards section of the app. You can link up to ten credit or debit cards to your MoneyPlus Rewards scheme, and the payment cards do not need to be in your name.

You are responsible for obtaining the cardholder’s permission to link their credit or debit card to the scheme. MoneyPlus Rewards accepts no liability for any transactions made on a third party’s card without their permission.

If you have not linked a valid payment card to your account, purchases made under the MoneyPlus Rewards scheme will not count as qualifying purchases and you will not earn cashback on them. 

We also strongly recommend that you update your contact preferences when you first register, as explained in Section 6.

2. Earning cashback.

Once you have set up your MoneyPlus Rewards account in the app and linked this to an active MoneyPlus Energy supply, you can start earning cashback through the participating retailers in the app.

MoneyPlus Rewards provides an overview of the offers available through the Rewards section of the app, and you can click into these offers for a summary of the offer (including cashback you can earn) and any restrictions on the purchase (e.g. a maximum value or volume of purchases). 

When you make any purchase with a participating retailer, you must use a payment card which is active and linked to your MoneyPlus Rewards account. This is a qualifying purchase

When you make your transaction, MoneyPlus Rewards are able to track the completion of your purchase and the participating retailer is notified to award the cashback to your MoneyPlus Rewards scheme account. 

If you make your purchase with a participating retailer but you use a payment method that is not linked to your app account, the transaction will not qualify for cashback reward. You are responsible for ensuring that the correct process is followed to qualify for cashback, and MoneyPlus Rewards accepts no liability for errors made by you in this process that result in no cashback being applied.

Cashback rewards cannot be earned on transactions made through:

  • YoYo Wallet
  • Curve cards
  • PayPal when a card is not linked (i.e. when a PayPal account is directly linked to a bank account)
  • Retailer store cards or gift cards
  • Cards not bearing the Visa, Mastercard/Maestro or American Express symbols

Once you have made a qualifying purchase through the app, it will take up to 72 for your cashback to appear as ‘pending’ on your account. After verification with the participating retailer, this will transfer to a confirmed cashback amount in your digital wallet within a further 14 calendar days which you can then redeem as explained in Section 3.

You can see all transactions you have made through the MoneyPlus Rewards scheme by clicking ‘view transactions’ on your account section of the app.

We appreciate that, on occasion, you may wish to return or dispute any goods or products you have obtained through a qualifying purchase in the app. If you make a return, or the qualifying purchase transaction is invalidated, disputed or unpaid for some reason, then some or all of the pending or confirmed cashback will be removed from your account at our discretion. If you make a return for cash, store credit or credit to a different payment card than the one you paid with, we may still need to deduct some or all of your pending or confirmed cashback balance accordingly.

MoneyPlus Rewards is dependent on the information we receive from the participating retailers and platform affiliates (e.g. payment processors) to confirm and issue the cashback to your digital wallet. We and the card networks (e.g. Visa, Mastercard) are not liable for your use of the card at any of the participating retailers or elsewhere, for the transaction conducted, or any returns or attempted returns at the participating retailers. 

You are responsible for ensuring that any cashback rewards are properly credited to your digital wallet, and you should check your account regularly. If you believe that your cashback rewards have not properly accrued on your account for any reason, please notify us as soon as possible by emailing support@moneyplusrewards.com to explain the issue. 

Please note that we cannot investigate missing transactions until 5 working days after the time of the purchase so please allow us thirty (30) days to investigate, assess and correct the claims as needed. Our determination on disputed cashback claims is final. If we cannot determine that you followed the process in these Terms, we cannot guarantee that cashback awards can be credited later, even if we believe they should have been accrued at the point of sale.


Among other problems, technical issues with verification or transaction information may result in your purchase not being detected or verified accurately by the app. While we try to prevent that from happening, neither MoneyPlus Rewards nor our affiliates or participating retailers can be held liable for your inability to accrue cashback rewards in this context. 

3. Redeeming your cashback.

When you make qualifying transactions (as explained in Section 2 above), your cashback rewards will accrue in your digital wallet. You can check the balance of this cashback at any time within the App. 

The monies in your digital wallet can only be redeemed when you renew your energy plan with MoneyPlus Energy. You may choose to renew twice in less than a year, but you can only redeem your balance once in every 12 month period. To do this, simply click the ‘Redeem Cashback’ button in the Rewards section of the app.

If you choose to switch provider, any money in your digital wallet will be transferred to MoneyPlus Group and will become our property. It cannot be used to offset any liability that you may owe to us either at the time that you switch away from us, or after you have switched.

The full value of the cashback in your digital wallet will be attributed to the linked MoneyPlus Energy account within 72 hours of redemption.

Please note, MoneyPlus Energy require a minimum payment of £1.00 for all monthly payments. If the amount of cashback you are redeeming exceeds your Direct Debit payment to MoneyPlus Energy, your set Direct Debit will be reduced to £1.00 for the relevant month and the remaining cashback value will be rolled to the following payment.

For example, if your monthly Direct Debit to MoneyPlus Energy is £96 and you are redeeming total cashback of £124, your next monthly payment would be reduced to £1 instead of £96, and the remaining £29 cashback will be attributed to the next payment which would be reduced to £67. From the third payment, the Direct Debit would return to the usual £96 per month. 

There is no minimum amount of cashback required to be redeemed against your MoneyPlus Energy renewal. However, if you do not redeem any qualifying cashback within ninety (90) days of your MoneyPlus Energy supply renewing, the balance in your digital wallet will be classed as expired and will become the property of MoneyPlus Group.

If you have agreed to receive notifications through the App (e.g. push notifications), MoneyPlus Rewards will endeavour to alert you when you are able to redeem your cashback balance. However, we cannot guarantee that such alerts will be issued and it is your responsibility to ensure that any qualifying cashback is redeemed. 

Any redemption of cashback credit from your digital wallet is final. Once you have applied for the cashback to be redeemed against your MoneyPlus Energy account, you will not be able to claim any refund, exchange or transfer of the cashback balance. At no time is any cash or credit alternative available to the cashback credits earned. All cashback accrued through MoneyPlus Rewards can only be redeemed against MoneyPlus Energy payments. 

4. Payment.

The use of the app and the associated reward scheme is currently made available to users free of charge, but in order to redeem the cashback reward, users must be customers of MoneyPlus Energy for their active utility supply. 

In order to obtain a qualifying purchase to earn cashback within the app, you must link at least one active payment card (credit or debit) to your MoneyPlus Rewards account. You can link up to 10 payment cards, and if any card is in the name of another party (e.g. a friend, family member or partner), you are solely responsible for obtaining the cardholder’s permission to use this card and manage it in accordance with their wishes. MoneyPlus Rewards accepts no liability for users adding cards they have no permission to use, or any transactions that may occur as a result. 

All transactions made through the app are processed securely in line with the Payment Card Industry Data Security Standard (PCI DSS) as managed through Fidel Limited, our affiliate firm who provide our payment platform. You can find more information on Fidel and our other affiliates in our Privacy Notice.

If you make any transaction with a participating retailer that falls outside the scope of this app, your transaction will not qualify for cashback and no consideration will be entered into. For example, if you follow a link in the app but pay on a card that is not linked to the app, your transaction cannot be tracked and will not qualify. 

While we have no current intention to do so, should MoneyPlus Rewards decide to begin charging a fee for continued access to the app or associated services, we will provide you with at least 14 days’ notice and the right to terminate your account without penalty, including the redemption of any outstanding cashback credit in your digital wallet (subject to a minimum of £1.00 cashback). 

5. Participating retailers.

We are proud of the number of retailers who are supporting our scheme and working with MoneyPlus Rewards to help you generate cashback. We are continually working to add more retailers to the MoneyPlus Rewards scheme. 

As the participating retailers may change continually, we are unable to provide a specific list. However, details of all participating retailers are available through the Rewards section of our app, including the amount of cashback available and any restrictions for qualifying transactions.

We cannot guarantee the ongoing inclusion of any participating retailer, nor the amount of cashback that may be offered on transactions through these retailers.

6. Managing your account.

You can update your personal information in the account at any time, such as adding or removing the linked payment cards. If you attempt to make a payment using a card that is not valid (e.g. the expiry date has passed, the card number is incorrect, or the credit limit has been reached), it is unlikely that your purchase will be successful but if it is, it will not count as a qualifying purchase. You are responsible for ensuring your payment card details are correct. 

You can manage how we contact you about the rewards scheme through the Contact Preferences section of the app, as explained in Section 7 of these Terms.

You are responsible for keeping the login details to the account safe and secure, and you agree not to share your login details with anyone else. You must notify us immediately of any unauthorised use of your account by emailing support@moneyplusrewards.com. MoneyPlus Rewards is not liable for any loss or damage from your failure to comply with these requirements. 

7. Communications, messages and push notifications.

When you use our app, you can choose to receive notifications about the MoneyPlus Rewards scheme. These notifications can be sent by push notification to your device through the app, SMS text messages or email. You have control over these settings, which can be updated in the Contact Preferences section of the ‘More’ area of the app. 

The notifications we send to you may provide advertising or promotions based on your use of the app, or to make you aware of new retailers or special offers that can help you maximise the cashback you can earn on qualifying purchases. 

Please note, if you have disabled push notifications on your device’s operating system, we will not be able to issue you push notifications through the app, even when this option is selected. 

Depending on the plan you have with your mobile network provider, fees may apply for push notifications or SMS messages. We are not liable for any fees you may incur by choosing to receive these notifications.  

Applicable laws require that some of the information or communications we send to you should be in writing. When using our app and rewards scheme, you accept that communication will be electronic. We will contact you by email, text message or through the app (e.g. notices on your homepage, push notifications). 

For contractual purposes, by entering into the MoneyPlus Rewards Scheme, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights. 

8. License.

When you agree to abide by these Terms, we grant you a non-transferable, non-exclusive personal licence to use this App and associated services on supported devices, subject to these Terms and the associated Apple iTunes and Google Play Store conditions. We reserve all other rights.

You may download one copy of the App onto your device and access, view, use, and display the App and its contents on the device for your personal, non-commercial purposes only. There are no restrictions on the number of devices you can install the app on. Except as expressly set out in these Terms or as permitted by any local law, you agree:


i) not to copy the application or services except where such copying is incidental to normal use of the application, or where it is necessary for the purpose of back-up or operational security;
ii) not to rent, lease, sub-licence, loan, translate, merge, adapt, vary or modify the app or its contents, including any and all copyrighted or trademarked material;
iii) not to make alterations or modifications to the whole or any part of the app, or permit the app or any part of it to be combined with, or become incorporated in, any other programs;
iv) not to disassemble, decompile, reverse-engineer or create derivative works based on the whole or any part of the app or attempt to do any such thing except to the extent that (by virtue of Section 296A of the Copyright, Designs and Patents Act 1988) such actions cannot be prohibited because they are essential for the purpose of achieving inter-operability of the app with another software program, and provided that the information obtained by you during such activities,
 (a)  is used only for the purpose of achieving inter-operability of the app with another software program;
 (b) is not unnecessarily disclosed or communicated without our prior written consent to any third party; and
 (c) is not used to create any software that is substantially similar to the app.
v) to keep all copies of the app secure and to maintain accurate and up to date records of the number and locations of all copies of the app;
vi) to include our copyright notice on all entire and partial copies you make of the app on any medium;
vii) not to provide or otherwise make available the app in whole or in part (including object and source code) in any form to any person without prior written consent from MoneyPlus Rewards; and
viii) to comply with all technology control or export laws and regulations that apply to the technology used or supported by the app or associated services.
By accepting these Terms, you agree that all confidential information, copyright and other intellectual property rights in this app belong to MoneyPlus Rewards. You acknowledge that you have no right to have access to the app in source-code form. 

9. If you downloaded this app from iTunes.

The following terms also apply where you acquire our App from the iTunes Store (“iTunes-Sourced Software”):

  • You acknowledge and agree that theseTerms are solely between you and MoneyPlus Rewards, not Apple Inc (“Apple”) and that Apple has no responsibility for the iTunes-sourced software or content whatsoever;
  • Your use of the iTunes Sourced Software must comply with the Apple app store Terms of Service; 
  • You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the iTunes-Sourced Software;
  • In the event of any failure of the iTunes-Sourced Software to conform to any applicable warranty, you may notify Apple, and Apple will (if applicable) refund the purchase price for the iTunes-Sourced Software to you (to the maximum extent permitted by applicable law). Apple will have no other obligation or liability whatsoever with respect to the iTunes-Sourced Software, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be solely governed by these Terms and any law applicable to MoneyPlus Rewards as the provider of the iTunes-Sourced Software;
  • You acknowledge that Apple is not responsible for addressing any claims you or any third party have relating to the iTunes-Sourced Software or your possession and/or use of the iTunes-Sourced Software and all such claims are governed solely by these Terms and any law applicable to MoneyPlus Rewards;
  • You and MoneyPlus Rewards acknowledge and agree that Apple and Apple’s subsidiaries are third party beneficiaries of these Terms and have the right to rely on these Terms as it relates to your license of the iTunes-Sourced Software.
  • You agree that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country and you are not listed on any U.S. Government list of prohibited or restricted parties

10. If you downloaded this app from the Google Play Store.

The following terms also apply where you acquire our app from the Google Play Store (“GooglePlay-Sourced Software”):

  • You acknowledge and agree that these Terms are solely between you and us and not Google Inc (“Google”) and that Google has no responsibility for the GooglePlay-Sourced Software or content whatsoever.
  • Your use of the GooglePlay-Sourced Software must comply with the Google Play app store Terms of Service.
  • You acknowledge that Google has no obligation whatsoever to furnish any maintenance and support services with respect to the GooglePlay-Sourced Software.
  • In the event of any failure of the GooglePlay-Sourced Software to conform to any applicable warranty, you may notify Google, and Google will (if applicable) refund the purchase price for the GooglePlay-Sourced Software to you (to the maximum extent permitted by applicable law). Google will have no other obligation or liability whatsoever with respect to the GooglePlay-Sourced Software, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be solely governed by these Terms and any law applicable to MoneyPlus Rewards as the provider of the GooglePlay-Sourced Software.
  • You acknowledge that Google is not responsible for addressing any claims you or any third party have relating to the GooglePlay-Sourced Software or your possession and/or use of the GooglePlay-Sourced Software and all such claims are governed solely by these Terms and any law applicable to MoneyPlus Rewards.
  • You and MoneyPlus Rewards acknowledge and agree that Google and Google’s subsidiaries are third party beneficiaries of these Terms and have the right to rely on these Terms as it relates to your license of the GooglePlay-Sourced Software.
  • You agree that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country and you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Data protection.

In order to provide our services to you, MoneyPlus Rewards must collect and process certain limited information about you and your payment cards. We also need to utilise third party companies, such as Fidel Limited, to provide the necessary platform to track your purchases in order to earn your cashback. We take the security of your personal data extremely seriously, and we will only share anonymised data with our third party firms (i.e. they will not be able to identify who you are from this information). We also do not share any of the information we collect or process in your use of this app with any third party company for marketing purposes. For more information on what data we collect and how we use it, please see our app’s Privacy Notice.

12. Rules of acceptable use.

In addition to the other requirements within these Terms, this section explains the specific rules that apply to your use of our app and the MoneyPlus Rewards scheme, which constitute our rules of acceptable use:

When using the Application and associated Services you must not:

  • circumvent, disable or otherwise interfere with any security related features of the app or services that prevent or restrict use or copying of the content accessible via the Platform;
  • use the Platform for any commercial purpose;
  • use the app or any services if we have suspended or banned you from using it;
  • create more than one account on the app (this does not restrict you from connecting more than one named person’s card), give any false or misleading information in your account details, impersonate any other person, misrepresent your identity, or falsely give the impression that you are someone else;
  • modify, interfere, intercept, disrupt or hack the app or services, misuse the app or services by knowingly introducing viruses, trojans, worms, logic bombs or other material which would harm the app or any of the services or any user of the app or service’s own equipment, send any junk, spam or repetitive messages, collect any data from the app and services other than in accordance with these Terms, or engage in any illegal or unlawful conduct;
  • misuse the app or services to increase the cashback credit you have (or any other user has) obtained or is due to obtain, otherwise seek to alter your (or any other user’s) eligibility for any such cashback credit or unfairly or unlawfully interfere with, distort, undermine or manipulate the calculation of cashback, ultimately leading to the collection and application of the cashback credit to your digital wallet;
  • submit or contribute any user content (including comments, reviews and descriptions) that contains nudity or violence or is abusive, threatening, obscene, misleading, untrue or offensive;
  • submit or contribute any user content without the permission of the content owner or otherwise infringe the copyright, trademark or other rights of third parties or submit or contribute any information or commentary about another person without that person’s permission.

Failure to comply with these Rules of Acceptable Use constitutes a serious breach of this Agreement/these Terms, and may result in us, the Merchant’s and/or the Network Provider’s taking all or any of the following actions (with or without notice):

  • the forfeiting of any cashback or pending cashback awarded to you;
  • immediate, temporary or permanent withdrawal of your right to use the app;
  • immediate, temporary or permanent removal of any user content;
  • issuing of a warning to you;
  • legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; 
  • disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

These responses detailed above are not limited, and we and such other parties may take any other action we reasonably deem appropriate.

13. Third party websites, services and resources.

The app and the associated services through the MoneyPlus Rewards scheme may contain content or services provided by third parties and/or links to third party services, websites or resources. We are not responsible or liable for the availability, accuracy, functionality, adherence to third party policies or our policies, or the legality of, and we do not endorse, such websites, services, or resources, or the content, products, or services on or available from such websites or resources. You are solely responsible for and assume all risk arising from your use of any such websites, services or resources. 

14. Inactive accounts.

We may deem your account inactive if you have not actively used the app for 180 days or more. Activity is deemed, at minimum, to be logging into the app but does not require the completion of any qualifying transaction. 

Once your account is deemed inactive, any or all cashback rewards in your digital wallet and/or pending cashback rewards within your account will be forfeited at any time, without notice, and your account will be terminated. 

If your cashback rewards are not used or redeemed within 700 days or more of when they are awarded, they will be deemed to have expired and any balance will be transferred to MoneyPlus Group.

15. Complaints.

If your complaint relates to the performance of your service, supply or portal access from MoneyPlus Energy, please contact their Customer Services Team on 0161 509 4747 or by email at theteam@moneyplusenergy.com to discuss your concerns. For more information about how MoneyPlus Energy will deal with your complaint and your rights to escalate your concerns, please read their Complaints Policy

If you have a complaint about the MoneyPlus Rewards Scheme or any transaction involved, please contact us on support@moneyplusrewards.com. On receipt, we will investigate your concerns and attempt to respond to you within five working days. If your complaint relates to a particular transaction or participating retailer, please provide us with the date of your purchase and any receipt, confirmation or similar correspondence from the retailer to assist our investigation. Please note that if we need to discuss the situation with individual retailers or our platform affiliates, this may take some time. In any event, we will respond to you within eight weeks of receiving your complaint.

16. Termination and cancellation.

You may terminate your account with MoneyPlus Rewards at any time and for any reason by deleting your account via the app or by sending us an email requesting cancellation to support@moneyplusrewards.com. By cancelling your membership, the account registered to you will be terminated and may no longer be accessible, and any cashback accrued that has not been redeemed will immediately be forfeited.

Any cancellation request will be completed within 30 days of receipt by us. Any suspension, termination or cancellation will not affect your obligations to us under these Terms (including but not limited to ownership, indemnification, and limitation of liability), which are intended to survive such suspension, termination, or cancellation.

We may immediately terminate your Account or suspend your access to the app and associated services and remove any material (including any content provided by you, such as reviews) from the services or our servers in the event that you breach these Terms or for any other improper conduct (such as repeat refunds or disputes on qualifying transactions), at our sole discretion and without prior notice to you. As a result of such termination, we may disqualify you from future participation in our programs and services (whether existing at present or in the future). We also reserve the right to terminate your account or suspend your access to the app and associated Scheme at any time and for any reason, including but not limited to the need to conduct maintenance or if we discontinue any part of the services.

Upon termination, all licenses and other rights granted to you under these Terms will immediately cease, and you will forfeit all cashback accrued. 

17. Waiver and severability.

If we fail to insist upon strict performance of any of your obligations under this agreement or these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations. A waiver by us of any default will not constitute a waiver of any subsequent default. No waiver by us of any of these Terms will be effective unless it is expressly started to be a waiver and is communicated to you in writing.

If any court or competent authority decides that any provisions of this Agreement or Terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining Terms, which will continue to be valid to the fullest extent permitted by law.

18. Changes to these Terms.

We may revise these Terms from time to time, but the current version will always be available through the ‘More’ section of this app. Changes will usually occur because of new features being added to the app or the wider scheme, changes in the law or where we need to clarify our position on something. In all cases we will try where possible and reasonable to contact you to let you know about any significant changes to these Terms. We may contact you through the app or via separate email for this purpose. Normally, we will try to give you some warning before the new Terms take effect, however, sometimes changes will need to be made immediately and if this happens, we reserve the right not to give you any prior notice and we will not be liable for any loss (to the extent permitted by law) associated with such changes.

19. Our liability/disclaimers. 

Commentary and other materials posted on our app are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our app, or by anyone who may be informed of any of its contents. We will not be responsible or liable to any third party for the content or accuracy of any materials posted by you or any other users of our app. 

MoneyPlus Rewards will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control (a Force Majeure Event). 

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (but without limitation): (i) strikes, lock-outs or other industrial action; (ii) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; (iii) fire, explosion, storm, flood, earthquake, subsidence, or other natural disaster; (iv) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; (v) impossibility of the use of public or private telecommunications networks; (vi) the acts, decrees, legislation, regulations or restrictions of any government; and (vii) pandemic or epidemic, including related public health protection measures. 

Our performance of obligations is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the Force Majeure Event.

Your use of this app is at your sole discretion and risk. We will not be responsible for (to the extent we are able to do so by law) any harm to your device, loss of data, personal injury, property damage, or other harm that results from your use of the MoneyPlus Reward Scheme and/or app. Due to the nature of the internet and technology, this app and its associated scheme services are provided on an “as available” and “as is” basis, and as such we do not make any warranties or promises: (i) regarding the security, accuracy, reliability, timeliness and performance of the Reward Scheme app; or (ii) that the Reward Scheme and/or app will be error-free or that any errors will be corrected. We will not be liable, and you are solely responsible, for any access or usage charges charged by your wireless carrier or network provided related to any device that you use to access or use the app or the Scheme.

MoneyPlus Rewards is not responsible for (i) incorrect or inaccurate transcription of information, (ii) problems related to any of the equipment or software associated with the Scheme or app or used by you, (iii) human error outside our reasonable control, (iv) any interruption, deletion, omission, degradation, defect, or line failure of any telephone network or electronic transmission, or (v) problems relating to inability to access an app or service. 

We disclaim (to the maximum amount permitted by applicable law) all liability for any technical failures or errors of, on, or connected to the Reward Scheme or app, including but not limited to push notifications or alert messages sent erroneously due to technical failures or errors. We will use reasonable efforts to correct any such failures within a reasonable period upon discovering them or being informed about them. If you think you have received push notifications or alert messages in error or experienced other technical failures, please contact us immediately. 

Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors
  • Fraud or fraudulent misrepresentation
  • Any other matter in respect of which it would be unlawful pursuant to English law for us to exclude or restrict liability

In addition, we will never be responsible for any loss and/or damage which is not reasonably foreseeable. For more information about your legal rights, you should contact your local trading standards bureau. 

20. Indemnity.

You agree to defend, indemnify, and hold MoneyPlus Rewards, our officers, directors, employees and agents harmless from and against any claims, liabilities, damages, losses and expenses, including without limitation all reasonable legal fees and costs, arising out of or in any way connected with (i) your access to or use of the app or MoneyPlus Rewards scheme; (ii) your breach of this agreement and/or your breach or violation of these Terms, including without limitation any representations made herein; or (iii) your breach or violation of any third party right, including without limitation any intellectual property right, or publicity, confidentiality, property or privacy right. 

21. Governing law and jurisdiction.

These Terms and your agreement with MoneyPlus Rewards, and any dispute or claim arising out of this agreement or Terms or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law.

Any dispute or claim arising out of or in connection with such agreement or Terms or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
